TOR Responsibilities
TECHNICAL OFFICER REPRESENTATIVE (TOR)
This document summarizes the responsibilities of the BITS II TOR. The TOR must be COTR-certified, and technically qualified to oversee the contractor's performance. The TOR should take a Contracting Officer's Technical Representative (COTR) refresher course annually.
The overall responsibilities of the TOR include preparing the Statement of Work (SOW) and Independent Government Cost Estimate (IGCE), ensuring that the IGCE Labor Categories are appropriate for the requirements of the SOW, and that contractor complies with the terms and conditions of the task and deliverables. The TOR provides technical instructions to the contractor regarding the specific task requirements specified in the Task Order. The TOR monitors the Task Order funding status and costs, and approves or disapproves invoices for payment. The TOR shall also maintain a complete record of all Task Order documentation and communications, and shall communicate any significant performance issues to the BITS II COTR or CO.
The TOR roles and responsibilities are distinct from those of the BITS II COTR. The BITS IICOTR is responsible for the overall contract and any technical matters as they relate to the underlying BITS II contract.
Extreme care must be taken to assure that the TOR does not cross the line of personal services. In administering the contract, the difference lies within the distinction between technical advice, which is proper and necessary, and supervision, which is improper.
A number of TOR responsibilities are detailed below. Should an issue arise that is not covered herein, the TOR should contact the BITS II COTR or CO for guidance.
PREAWARD
- Preparing SOW, IGCE and Special Considerations and any other pre award documentation in accordance with specifications detailed in SOP. As appropriate, preparing comparison review criteria or a comparison review plan. Assisting BITS II acquisition team in modifying documents to comply with BITS II contract and AMS requirements. Ensuring that proposed staffing is appropriate to the level of education, skill and experience specified in the SOW.
- Assisting in the review of Contractor proposed Workplans, and in negotiations when requested, providing appropriate comments and recommendations.
- Reviewing proposed contractor personnel resumes to ensure BITS II contract education and experience requirements are met.
POST AWARD
- Reviewing and documenting contractor deliverables and performance, and communicating issues and concerns with BITS II COTR and CO.
- Receiving and reviewing copies of all correspondence with the Contractor concerning technical instructions to assure that the scope of the work is not altered.
- Notifying the BITS II COTR of inefficient or wasteful methods being utilized on the contract, and recommending corrective/preventive measures.
- Maintaining a file of all technical instructions issued and a record of all deliverables received, citing their disposition;
- Providing written notification to the CO if for any reason your tenure as TOR is recommended for termination with supporting rationale.
- Monitoring Contractor performance to ensure contract compliance and suitability of Contractor personnel.
- Serving as the contact through which the Contractor can relay questions and problems of a technical nature to the BITS II COTR and CO.
- Ensuring the Contractor's compliance with Agency safety and security requirements.
- Forwarding a copy of all Government technical correspondence to the BITS II COTR and CO.
- Furnishing the CO promptly with any request for waiver (whether generated by Government or Contractor personnel), and preparing supporting documentation.
- Reviewing and certifying invoices, and tracking funding and expenditures. Document and promptly report any discrepancies to the BITS II COTR.
