LOS ANGELES — The Federal Aviation Administration has proposed to assess a $50,000 civil penalty against Montroy Supply Company of Commerce, Calif., for allegedly violating Department of Transportation hazardous materials shipment regulations.
FAA alleges that Montroy offered a fiberboard box containing a five-gallon container of paint, a flammable liquid, to Southwest Airlines for transportation by air from Las Vegas, Nev. to Phoenix, Ariz. The package was discovered in Las Vegas when a Southwest Airlines cargo employee found the package had opened. The shipment was not properly described, marked, labeled or accompanied by the proper shipping documents. In addition emergency response information was not made immediately available for use at all times the hazardous material was present.
Montroy had 30 days from receipt of the FAA notice to submit a reply to the agency. The company requested an informal conference with FAA to discuss the proposal.
This announcement is made in accordance with the FAA's practice of releasing information to the public on newly issued enforcement actions involving penalties of $50,000 or more.
