Operations conducted as a Public Aircraft COA (Part 91) are limited to those operations that meet the definition of a Governmental Function (see 49 USC 40125(a)2). If the community event does not meet this definition, the operation must be conducted under 14 CFR Part 107 and any necessary additional waiver or authorizations from the FAA depending on the operation and airspace.

The remote pilot in command of the small UAS or drone is required to report an accident to the FAA within 10 days if it results in at least serious injury to any person or any loss of consciousness, or if it causes damage to any property (other than the UAS or drone) in excess of $500 to repair or replace the property (whichever is lower).

No. Part 107 Operators are responsible for checking to ensure the proposed operation occurs outside all 14 CFR 99.7 TFRs and Special Use Airspace. The UASFMs and 99.7 restrictions are all available on the same website. All other TFRs are posted to the FAA's Notice to Airmen (NOTAM) website.

The FAA currently does not provide guidance or data regarding critical infrastructure. The FAA has started the rulemaking process for FESSA 2209, which will allow non-federal entities to request similar flight restrictions. Under the proposed new rule, critical infrastructure will be defined, and qualifying locations will be allowed to request UAS flight restrictions.

The FAA’s Reauthorization Act of 2018 introduced new rules for how, when, and where drones can be flown for recreational purposes (49 U.S.C. Section 44809 – referred to as the Exception for Limited Recreational Operations of Unmanned Aircraft). The law requires that all recreational flyers must pass an aeronautical knowledge.

In order to make the test accessible and available to the largest viable audience, the FAA is seeking test administrators. The law permits the FAA, a community-based organization, or a person designated by the FAA Administrator to administer the test electronically.

Current 333 exemption renewal requests will be processed under the FAA's new Special Authority for Certain Unmanned Systems, 49 USC 44807. Exemptions for operations that can be conducted under 14 CFR part 107 will not be renewed. Requests for small UAS operations that require waiver (e.g. night operations, operations over people, etc.) should be submitted as requests for waiver under part 107.
