Decision Protest dismissed by Administrator for lack of timeliness. A protest was filed by Wesson International (“Wesson”) against the FAA’s Technical Center (“Center”) challenging the award by the Center of a contract for an air traffic control tower simulator. Although the contract had been awarded on September 23, 1999, the protest was not filed until January 10, 2000. Nonetheless, Wesson claimed that its protest was timely because it did not discover the grounds for the protest until mid-December, when it received a response to a Freedom of Information Act (FOIA) Request. The Center ; moved for Summary Disposition on the basis that the protest was not timely filed. Wesson had claimed that no debriefing had been available and that it was told to file a FOIA request in order to obtain information on the award decision. The ODRA assumed the truth of this assertion for purposes of the summary motion but nevertheless concluded that the protest was clearly untimely. In this case, Wesson failed to file its protest even within 7 working days of its receipt of the FOIA response. (ODRA Findings and Recommendations and Administrator's Order).
