Filing Notice with the FAA
Southwest Region Airports Division
Title 14, CFR Parts 77 and 157 establish notification requirements.

- Part 157 - Notice of Construction, Alteration, Activation, and Deactivation of Airports
Please note, the FAA office that will process and issue a determination or your proposal is dependent on the type of notice you are filing, the location of the construction and the details of the proposed construction or alteration.
Notifications filed in accordance with CFR Part 77, "not" located on a Public-use airport are processed by the FAA's Obstruction Evaluation Group
The process for notifying the FAA "for all proposals" is through the Obstruction Evaluation/Airports Airspace Analysis (OEAAA) website.
Notifications filed in accordance with CFR Part 77, "on" a Public-use airport located in Arkansas, Louisiana, New Mexico, Oklahoma or Texas are processed by the FAA's Southwest Region Airports Division.
- Please note: Airports that have received federal funds are obligated by grant assurance to identify and mitigate hazards to navigable airspace at their airport.
- Proposals are considered either permanent, temporary or planning - Please do not combine temporary construction activity with the permanent structure.

Notifications filed in accordance with CFR Part 157, for a new landing area or to establish, activate or deactivate airports located in Arkansas, Louisiana, New Mexico, Oklahoma or Texas are processed by the FAA's Southwest Region Airports Division.
The process for notifying the FAA "for all proposals" is through the Obstruction Evaluation/Airports Airspace Analysis (OEAAA) website.
Q - How long will it take for the FAA to complete an aeronautical study and issue a determination for a proposal?
A - It depends… For On Airport proposals, the FAA Southwest Region Airports Division strives to issue determinations within 45 days after verifying the information and location (placing your proposal in "work status").
Q - This is new to me, what's my first step?
A - You will need to register and establish an OEAAA account by selecting New User Registration.
Q - I don’t see anything on the OEAAA website about an airport, heliport or landing area. What do I do?
A - Once you register and login to your account, you will be able to click on a hyperlink (left side menu) to Create a New Landing Area Proposal within the On Airport Construction box.
Q - My private airport isn't very active and only a couple people use my airport, why do I need to file notice with the FAA?
A - Owners/proponents of "all" landing areas are required to notify the FAA in accordance with 14 CFR Part 157. As our National Airspace System (NAS) continues to become more crowded, it is important that existing and proposed private and public use facilities remain properly identified within the NAS to ensure safe and efficient use of airspace by aircraft and the safety of persons and property on the ground.
