FOIA and Case Data Packet Information
Information typically requested under FOIA are a Final Toxicology Report or a Case Data Packet.
- Final Toxicology Report is the official toxicology report of an individual tested in the Forensic Sciences laboratory.
- A Case Data package consists of the Final Toxicology Report, chain of custody records, analytical test records, and quality control records.

General FOIA for FAA accidents/incidents
- Members of the general public must submit a FOIA request by one of the above methods.
- FOIA requests may be made 15 days after final report has been signed. However, if the report is not complete, or the required 15 days for NTSB or FAA review have not occurred, a response will be submitted indicating a final report to be sent upon completion.
- All information requested under FOIA will be transmitted by U.S. Mail or other mutually acceptable means.
FOIA for non-fatal accidents/incidents
- FAA order 8020.11c states in Chapter 4, “Section 14. Airman and Aircraft Records. The FAA is prohibited from releasing the medical records of any living person without the individual's consent.”
- Release of records on non-fatal persons requires a written release from the individual being tested.
- In the absence of a written release from the individual being tested, 5 USC 552a(b) (11) allows records to be released pursuant to an order of a court of competent jurisdiction (not a subpoena duces tecum). This must be signed by a judge of the court, not a clerk of the court.
- Information and process required for an individual to request their own toxicology information.
- Accident Information:
- Date and Location of Accident
- NTSB# (if known)
- Airman Full Name and Address
- Address for Tox Report to be released to if different from requesting Airman’s address
- The request MUST include the following statement:
- Statement Under Perjury: I declare under penalty of perjury under the laws of the United States of America that the foregoing is true and correct, and that I am the person named above, and I understand that any falsification of this statement is punishable under the provisions of 18 U.S.C. Section 1001 by a fine of not more than $10,000 or by imprisonment of not more than five years or both, and that requesting or obtaining any record(s) under false pretenses is punishable under the provisions of 5 U.S.C. 552a(i)(3) by a fine of not more than $5,000.
- The request MUST be signed and dated by the requesting airman.
- A wet signature is preferred
- Electronic Signature:
- An electronic signature can be a “typed” name or an electronic copy of a hand-scribed signature.
- If the electronic is anything but a “typed” signature, the name must also be typed out.
- The electronic signature must show evidence of the signer’s authenticity, such as “digitally signed by” and the software’s water mark and time and date of signing, or must have an authentication code or key identifier identifying the software provider. A simple electronic signature, such as a copy of a cursive signature or one that is applied through the signature on a computer screen, is not acceptable and will be sent back. There must be something more than a simple signature to prove authentication.

FOIA for non-FAA accidents/incidents
- All surface accident requests must be referred to the agency responsible for that mode of transportation.
- Results for foreign governments are ONLY releasable to the requesting foreign government. Requests for reports/information should to be referred to the appropriate foreign government agency.
